Today I talked about the role of the 14th Amendment in the Progressive Era. You can hear the barn door creaking open if you read between the lines in Muller v. Oregon: "While the general liberty to contract in regard to one's business and the sale of one's labor is protected by the Fourteenth Amendment, that liberty is subject to proper restrictions under the police power of the State." (208 US 412)
